IP plans wont stop copycats

A major review of intellectual property will not protect brand owners from copycat packaging or make it easier for them to prove trademark infringement in court, according to lawyers in the field.

Simon Clark, head of IP at Berwin Leighton Paisner, said he was disappointed that Andrew Gowers’ Treasury-commissioned review, while recognising the failings of existing laws, merely called for “continued scrutiny” from the government.

Stephen Sidkin, commercial law partner at Fox Williams, said the £5m earmarked by the Treasury to enable trading standards officers to better enforce intellectual property laws was “a drop in the ocean that will go nowhere fast”.
