Rapid Racking penalised under packaging waste rules

Rapid Racking has been ordered to pay 25,000 under the Producer Responsibility Obligations (Packaging Waste) Regulations for failing to recycle and recover packaging waste.

The Environment Agency (EA) estimated the Gloucestershire storage company had avoided costs of £17,484 by not registering and purchasing the correct amount of packaging recovery notes.

Cheltenham Magistrates Court yesterday (2 March) fined Rapid £15,000, plus compensation of £8,354 and the £15 government surcharge. The firm also has to pay the EA £1,684 in costs.

Rapid pleaded guilty to not complying between 2004 and 2006, and pointed to 13 similar offences between 1997 and 2003.

The firm engaged a compliance scheme in April 2007, but membership was not communicated to the EA until the September.

Under the Producer Responsibility Obligations (Packaging Waste) Regulations firms with a turnover that exceeds £2m a year and that handle more than 50 tonnes of packaging must register with the EA or compliance scheme to provide evidence of payment for packaging recovery.

EA investigating officer Sue Gebbels said it was disappointing there were “still a significant number of companies that were not compliant” with the regulations.

Kemble-based Rapid Racking supplies a range of storage, shelving and racking systems. The firm was unavailable for comment at the time of publication.
