DuPont wins US patent infringement appeal

DuPont Imaging Technologies has won an appeal in a patent infringement lawsuit against MacDermid Printing Solutions in the US.

The US Court of Appeals for the Federal Circuit ruled that a lower court had made a mistake when it questioned the validity of DuPont's patent protecting its Cyrel Fast thermal flexographic technology, over confusion about the patent's proper filing date.

It also ruled that DuPont had shown a reasonable likelihood that MacDermid infringed one of its patents.

DuPont will now renew its motion for a preliminary injunction seeking to stop sales of MacDermid's Lava thermally developed flexo printing plates, including products marketed by MacDermid under the names MLT and Magma.

Linda West, vice president and general manager of DuPont Imaging Technologies, said: "We are very pleased with the decision and will continue to pursue our patent infringement claim against MacDermid. We are confident we will ultimately win."

The case started in October 2006.
